A gate attendant in Ormond Beach was arrested on Tuesday for allegedly firing shots near a man who he felt was not supposed to be in the neighborhood. 59-year-old Gary Nagel was charged with aggravated assault with a deadly weapon without intent to kill and discharging a firearm in public. Officers with the Ormond Beach Police Department became aware of the shooting during their investigation into an alleged DUI. A 24-year-old woman was arrested after a crash on two counts of DUI with property damage and one count of refusal to submit to DUI testing. The crash took place on Fountain View Street. Officers learned that the suspect’s boyfriend was apparently walking through the neighborhood looking for her. At one point he was said to be walking along Plantation Oaks Blvd, going toward Merimont Lane. As he was walking, the man was reportedly asked by Gary Nagel – the gate attendant – to leave the area. A conversation commenced with the man trying to explain to Nagel why he was there. This culminated in Nagel allegedly pulling a gun and firing multiple warning shots. The boyfriend is said to have run down the street away from Nagel, who allegedly continued firing multiple rounds into the ground near him. Fortunately, the OBPD says no one was injured in the shooting. Nagel was booked into the Volusia County Branch Jail on Tuesday. As of Wednesday he remains in custody without bond. There are no prior arrests on record for Nagel in Volusia County.
